Que fait une FA (Famille d’Accueil) exactement ?

Être FA pour l’association Galia, consiste à être famille d’accueil pour un chien ou un chat afin d’éviter qu’il reste en box au refuge.

Le principe est simple, vous recevez l’animal chez vous. Vous devez le nourrir, le câliner, jouer avec, le promener, bref vous vous en occupez comme si c’était le votre. Vous faites également passer quelques photos afin que nous le diffusions. Dès que l’animal va être adopté, l’association vous contacte et l’animal rejoint sa famille. Si toutefois vous craquez sur lui, vous pouvez également l’adopter.

Les frais vétérinaires sont à la charge de l’association avec accord préalable.

Combien coûte un chien de Galia ?

Nous ne demandons aux futurs adoptants qu’une participation aux frais engendrés par le chien à l’association. Certains chiens ne coûteront pas plus à l’association que ce qu’il sera demandé, et d’autres beaucoup plus…

Nous avons donc établi une grille de prix que nous jugeons raisonnables pour l’adoptant comme pour l’association, selon différents critères : âge, stérilisation, vaccination.

Que signifie le statut réservé ?

Le statut réservé permet de vous faire savoir qu’une famille a craqué pour lui, et que les papiers d’adoption sont en cours de signature. Entre les visites chez le vétérinaire et les envois postaux, il arrive que cela prenne un peu de temps.

 

Je déménage et mon nouveau propriétaire refuse les chiens, que faire ?

Le propriétaire ne peut pas interdire à un locataire d’héberger un animal de compagnie dans l’appartement ou la maison qu’il lui loue.

Si une clause inscrite dans le bail prévoit une telle interdiction, elle n’est pas valable au regard de la loi.

En revanche, les chiens de 1ère catégorie (chiens d’attaque) peuvent être interdits par le règlement de copropriété ou le bail.

Attention, l’animal ne doit pas causer de dégâts dans le logement loué ni dans les parties communes de l’immeuble en copropriété, ni provoquer de « troubles de jouissance » aux autres occupants (article 10 de la loi du 9 juillet 1970).

 

J’ai trouvé un animal divaguant / en détresse, que faire ?

Contacter la mairie de la commune.

Qu’est ce qu’un animal divaguant ? C’est un animal qui n’est plus sous la surveillance de son maître.

Pour les chiens, il s’agit du moment où l’animal ne peut plus entendre le rappel de son maître ou lorsqu’il se trouve à plus de 100 mètres ou lorsqu’il est abandonné.

Les chiens de chasse, de garde ou de protection de troupeaux ne sont pas concernés.

Pour les chats, il s’agit du moment où l’animal est à plus de 200 mètres de toute habitation ou à plus de 1 000 mètres du domicile de son maître ou s’il est saisi sur la voie publique ou le terrain d’autrui sans que son maître ne puisse être identifié.

Les propriétaires, laissant divaguer leur animal alors qu’il présente un danger pour les personnes, peuvent être punis d’une amende de 150 €.

Le maire prévoit les mesures nécessaires pour prendre en charge les animaux divagants. Il désigne un lieu de dépôt où doivent être confiés ces animaux et met à la disposition des habitants les coordonnées des services compétents pour la capture de ces animaux.

Mon animal a disparu, que faire ?

Dès que l’on constate la disparition de son chat ou de son chien, il faut prévenir :

  • La fourrière de la commune, ainsi que le refuge SPA le plus proche.
  • Le commissariat de police ou la gendarmerie, ainsi que les vétérinaires des environs.
  • Le I-CAD, si l’animale est identifié : 09 77 40 30 77 (Conseils et démarches cliquez ici: I-CAD)

Nous conseillons aussi de déposer des annonces sur des sites comme leboncoin.fr ou encore chien-perdu.org / chat-perdu.org et Pet Alert France, afin de multiplier les chances de retrouver son compagnon rapidement. N’oubliez pas de partager vos annonces sur les médias sociaux.

J’ai constaté un cas de maltraitance, que faire ?

Contactez la mairie de la commune :

Le maire de la commune où réside un animal susceptible de présenter un danger dispose de pouvoirs lui permettant de protéger les habitants.

Lorsque l’animal n’est pas bien gardé, le maire peut demander au propriétaire de prendre des mesures pour assurer la sécurité des personnes.

Si le propriétaire ne s’y conforme pas, le maire peut ordonner le placement de l’animal dans une fourrière.

Au bout de huit jours, si le propriétaire ne présente toujours pas les garanties nécessaires, le maire peut autoriser le gestionnaire de la fourrière à euthanasier l’animal ou à le donner à une fondation ou une association protectrice des animaux, qui pourra le confier à un nouveau propriétaire.

De plus, en cas de danger grave et immédiat pour la sécurité des personnes, le maire (à défaut, le préfet) peut ordonner le placement de l’animal dans une fourrière ou son euthanasie, sans délai (sans mise en demeure préalable du propriétaire), après avis d’un vétérinaire.


 CODE GÉNÉRAL DES COLLECTIVITÉS TERRITORIALES

Article L. 2212-2

La police municipale a pour objet d’assurer le bon ordre, la sûreté, la sécurité et la salubrité publique.

Elle comprend notamment : 7° Le soin d’obvier ou de remédier aux événements fâcheux qui pourraient être occasionnés par la divagation d’animaux malfaisants ou féroces.

Article 9

Tout animal étant un être sensible doit être placé par son propriétaire dans des conditions compatibles avec les impératifs biologiques de son espèce.

Pourquoi identifier son animal ? Est-ce obligatoire ?

Obligations légales

La Loi du 20 Juin 2008 interdit la cession d’un chien ou d’un chat sans un certificat vétérinaire qui indique le numéro d’identification de l’animal.

L’arrêté du 10 Octobre 2008 impose le passeport pour animaux de compagnie comme seul support de certification de la vaccination antirabique. Le passeport indique le numéro d’identification. Le nouveau passeport avec cahier central rose en fait le support général de vaccination et l’instrument de suivi des visites périodiques.

L’identification est obligatoire :

  • pour tous les chiens à partir de 4 mois ;

  • pour tous les chiens, chats et furets en cas de cession, par vente ou par don ;

  • si vous vous rendez en Corse ou à l’étranger.

  • dans les régions infestée par la rage ;

  • pour toute importation d’un chat, d’un chien ou d’un furet de l’Union Européenne ou d’un pays tiers.

Cette réglementation ancienne, inscrite au Code Rural français a été renouvelée et modifiée par une réglementation européenne établie dans un souci d’harmonisation et pour permettre la libre circulation des animaux avec leurs propriétaires, dès lors qu’ils respectent la règle commune.

Comment promener mon chien en toute légalité ?

Les maires peuvent ordonner que les chiens soient tenus en laisse, et même muselés, dans la rue. De nombreuses municipalités ont adopté de telles règles.

En outre, il est interdit de laisser un animal domestique divaguer, c’est-à-dire, pour un chien, se promener librement hors de portée de voix ou à plus de 100 mètres de vous (sauf participation à une action de chasse).

À défaut, vous risquez une amende et le chien peut être conduit à la fourrière.

L’identification est obligatoire.

 

Que sont les chiens catégorisés ?

Les chiens d’attaque

Les chiens de 1ère catégorie, (dits d’attaque), dont le maître ne peut retracer l’origine par un document, par exemple les pit-bulls, les chiens assimilables aux chiens de races mastiff et tosa.

Leur importation, achat, vente ou don sont interdits. Ils doivent être stérilisés.

Les chiens de garde et de défense

Les chiens de 2ème catégorie, (dits de garde et de défense) sont ceux de race, comme les staffordshire terriers, les rottweilers.

Des règles pour le propriétaire

Ne peuvent détenir un chien dangereux : notamment les personnes de moins de 18 ans et celles qui ont fait l’objet d’une condamnation inscrite au bulletin n° 2 de leur casier judiciaire.

Les propriétaires ou les détenteurs doivent déclarer le chien à la mairiede leur résidence et fournir la carte d’identification de l’animal, comportant son numéro de marquage, un certificat de vaccination antirabique en cours de validité, une attestation d’assurance garantissant leur responsabilité civile pour les dommages que l’animal pourrait causer et un certificat de stérilisation (pour les chiens d’attaque).

Interdits dans les lieux publics

Les chiens de 1re catégorie n’ont pas accès aux lieux publics (sauf la voie publique) et ne sont pas autorisés à stationner dans les parties communes d’un immeuble collectif.

Dans les lieux publics où ils sont autorisés, les chiens de ces deux catégories doivent être muselés et tenus en laisse par une personne majeure.

Les sanctions pénales en cas d’infraction à la législation sur les chiens dangereux viennent d’être renforcées (*).

What does a FA (Famille d’Accueil- Foster family) exactly do ?

Being a FA for Association Galia, consists of being a foster family for a dog or a cat to avoid them remaining in a kennel in the refuge.

The principle is simple, you take an animal into your home. You must feed it, cuddle it, play with it, take it walks, in other words you take care of it as if it were your own. You can also take some photos so that we can pass those around. As soon as the animal is ready to be adopted, the Association will contact you and the animal will join its family. If however you really take a shine to him or her, you can also adopt them.

Veterinary costs are taken care of by the association with prior agreement.

How much does a dog cost with Galia ?

We only ask potential adopters to pay a contribution towards the costs incurred by the association. Certain dogs will not cost more to the association than what is asked of it, and others a lot more…

We have therefore established a grid of prices that we think reasonable for the adopter as well as for the association,  according to different criteria: age, sterilisation, vaccination.

What does the status « reserved » mean?

The status « reserved » allows us to let you know that a family has been taken by him or her, and that the adoption papers are in the process of being signed. What with visits to the vet and postal despatches, it sometimes takes a little time.

 

I am moving and my new landlord will not accept dogs, what do I do ?

The owner cannot forbid a tenant from keeping a pet in the flat or house that he lets.

If a clause is written into the rental agreement outlining such a ban, it is not valid under the law.

On the other hand, dogs who come under category 1 (attack dogs) can be banned by co-ownership rules or the rental agreement.

Please note, the animal must not cause any damage to the rented accommodation nor to the communal parts of the building which is co-owned, nor provoke any « social disturbance» to other occupiers (under article 10 of the act dated 9 July 1970).

 

I have found a stray/distressed animal, what should I do?

Contact the mairie of the commune.

What is a stray animal? It’s an animal that is no longer in the custody of its owner.

For dogs, it counts from the moment when the animal can no longer hear its owner calling him back or when it is located more than 100 metres away or when it has been abandoned.

Hunting dogs, guard dogs or those that protect herds are not concerned by this.

As for cats, it starts from the moment the animal is more than 200 metres from any dwelling ou more than 1 000 metres from its owner’s home or if it is picked up on a public highway or land belonging to another, without being able to identify its owner.

Owners who allow their animal to stray, whilst this may present a danger to the public, can be punished by a fine of 150 €.

The mayor has necessary measures in place to deal with stray animals.  He/she designates a place for these animals to be desposited and makes available to all their residents the contact details for the services competent to round up such animals.

My animal has disappeared, what should I do?

Once you notice your cat or dog has gone, you should notify:

    • the pound for the commune, as well as the SPA refuge closest to you.
    • the commissariat de police or the gendarmerie, as well as the local veterinary practice.

We also advise you to place adverts on site such as leboncoin.fr , chien-perdu.org / chat-perdu.org and Pet Alert France,  so as to increase your chances of finding your pet quickly. Don’t forget to share your announcements on social media.

I have noticed a case of mistreatment, what should I do ?

Contact the mairie of the commune :

The mayor of the commune where an animal likely to present a danger resides, has powers at their disposal which allow him to protect the inhabitants.

When the animal is not being well kept, the mayor can request the owner to take measures to assure the safety of  people.

If the owner does not comply, the mayor can order that the animal be placed in a pound.

After eight days, if the owner still does not present the necessary guarantees, the mayor can authorize the manager of the pound to put the animal down or to hand it over to a foundation or an animal welfare charity, which can then pass it on to a new owner.

In addition, in a case that presents serious and immediate danger for the safety of the public, the mayor (by default, the prefect) can order the placement of the animal in a pound or for it to be put down, without delay (without prior formal notice from the owner) after having obtained the advice of a vet.

 


GENERAL CODE OF TERRITORIAL COMMUNITIES

Article L. 2212-2

The municipal police are there to ensure good order, the safety, the security and the health of the public.

Notably this includes: 7° The duty to take precaution against or remedy untoward events which could be occasioned by the straying of harmful or ferocious animals.

Any animal that is a sentient being must be placed by its owner in conditions that are compatible with the biological imperatives of its species.

 

Why do you have to identify your animal ? Is this obligatory?

Legal obligations

The Law of 20th June 2008 prohibits the transfer of a dog or cat without a veterinary certificate which indicates the identification number of the animal.

The Order of 10th October 2008 imposes the requirement of a passport for any pet, as the sole support for the certification of anti-rabies vaccination.  The passport indicates the identification number. The new passport with the central pink booklet does this with the general support of vaccination and shows the follow ups over periodic visits.

Identification is obligatory :

  • for all dogs from the age of 4 months ;
  • for all dogs, cats and ferrets in the case of transfer, sale or donation ;
  • if you go to Corsica or abroad.
  • in areas where rabies is widespread;
  • when importing any cat, dog or ferret from the European Union or from a third party country.

This old rule, written into the French Rural Code has been renewed and modified by a European ruling established  with a concern for harmonisation and so as to allow the free movement of animals with their owners, as long as they respect the common rule.

 

How do I walk my dog entirely legally?

Mayors can order that all dogs are kept on a lead, and even muzzled, in the street. Many towns have adopted such rules.

In addition, it is forbidden to allow a domestic animal to stray, that is to say, for a dog, to walk freely, beyond the reach of your voice or more than 100 metres from you (unless participating in a hunt event).

Failing this, you are at risk of a fine, and the dog can be taken to the pound.

Identification is obligatory.

 

Which dogs are categorised?

Attack dogs

Dogs of the 1st category, (so called « attack »), for which the mayor cannot trace the origin by a document, for example pit bulls, dogs of the same nature as breeds like mastiffs and tosa.

Their importation, purchase, sale or donation are banned. they have to be sterilised.

Guard dogs and those on defence

Dogs coming into the 2nd category, ( called guard or defence) are those from breeds such as Staffordshire terriers, and rottweilers.

Rules for the owner

You cannot keep a dangerous dog: notably minors under 18 and those who have a registered conviction on section 2 of their criminal record.

Owners or keepers must declare the dog at the mairiede where they reside and provide the identification card for the animal, comprising its marking number, a current vaccination certificate for rabies, an insurance policy document guaranteeing their public liability for any damage that the animal could cause and a sterilisation certificate (for attack dogs).

Forbidden in public places

Dogs in the 1st category are not allowed acces to public places (apart from the highway) et and their owner’s car cannot be parked in a communal area of a shared building.

In public places where they are authorized, dogs in these two categories must be muzzled and held on a lead by an adult.

Penal sanctions in the case of infringement of the legislation on dangerous dogs have just been reinforced (*).
